Terms of Service

These Terms of Service ("Terms") govern your access to and use of Activious LLC's website, content, and membership services. By joining the waitlist, purchasing a membership, or using any Activious service, you agree to these Terms. Please read them carefully.

1. About Activious

Activious LLC is an Oregon limited liability company providing wellness education, nutrition guidance, and community support for women on GLP-1 medications. Activious is not a medical practice, healthcare provider, or licensed clinical nutrition service. Our services are educational and wellness-focused only.

2. Eligibility

You must be at least 18 years of age to use Activious services. By agreeing to these Terms, you represent that you are 18 or older. Activious is designed for women navigating GLP-1 medication journeys and is not intended to diagnose, treat, or manage any medical condition.

3. Not Medical Advice

All content provided by Activious — including meal plans, guides, newsletters, coaching sessions, community discussions, and any other materials — is for general wellness and educational purposes only. Nothing provided by Activious constitutes medical advice, clinical nutrition therapy, diagnosis, or treatment.

Activious coaches are certified wellness coaches, not registered dietitians, physicians, or licensed healthcare providers. Their guidance does not replace the advice of your prescribing physician or any other licensed medical professional managing your care.

You should always consult a qualified healthcare provider before making changes to your diet, supplementation, or any aspect of your GLP-1 treatment plan.

4. Membership and Billing

Subscription tiers: Activious offers two membership tiers — Essential ($49/month, $39/month for founding members) and Essential + Coaching ($99/month, $79/month for founding members). Founding member rates are locked for life as long as your subscription remains active and uninterrupted.

Billing: Memberships are billed monthly on a recurring basis. Payment is processed through Stripe. By providing your payment information, you authorize Activious to charge your payment method on a recurring monthly basis.

Coaching tier launch: The Essential + Coaching tier launches in June 2026. Members who join the coaching tier before launch will be billed at the Essential rate until coaching becomes available, at which point billing will automatically move to the coaching tier rate.

Price changes: Founding member rates are locked and will not increase. Standard rates may change with 30 days advance written notice to active members.

5. Cancellation and Refunds

Cancellation: You may cancel your membership at any time from your account dashboard or by emailing kay@activious.com. Cancellation takes effect at the end of your current billing period. You will not be charged for the following month.

Refunds: Due to the nature of digital content and community access, we do not offer refunds for completed billing periods. If you cancel within 48 hours of your first charge and have not accessed member content, you may request a full refund by emailing us within that window.

Founding member rate: If you cancel your founding member subscription, your locked founding rate is forfeited. Rejoining at a later date will be at the then-current standard rate.

6. Community Standards

Activious maintains a private community for members. By participating, you agree to:

Activious reserves the right to remove any member from the community for violations of these standards without refund.

7. Intellectual Property

All content created by Activious — including meal plans, guides, educational materials, the website, branding, and all written content — is the intellectual property of Activious LLC. You may not reproduce, distribute, modify, or create derivative works from any Activious content without prior written permission.

Your membership grants you a personal, non-transferable license to access and use Activious content for your own personal wellness purposes only.

8. Limitation of Liability

To the fullest extent permitted by law, Activious LLC, its founders, employees, coaches, and medical advisors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to health outcomes, weight changes, nutritional deficiencies, or any other physical or medical outcomes.

You use Activious services at your own risk and are solely responsible for decisions you make regarding your diet, supplementation, exercise, and medical care.

9. Testimonials and Results

Testimonials on the Activious website reflect the personal experiences of individual members. They are not representative of typical outcomes and are not a guarantee of results. Individual results vary based on many factors including adherence, health status, medication, and lifestyle.

10. Third-Party Links and Referrals

Activious may from time to time reference or link to third-party services, including telehealth providers. These references do not constitute endorsement, and Activious is not responsible for the practices, content, or services of any third party. Any financial relationships with third-party referral partners will be disclosed in accordance with FTC guidelines.

11. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oregon.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify active members via email at least 14 days before the changes take effect. Your continued use of Activious after that date constitutes acceptance of the updated Terms.
